These Terms of Use ("Terms") govern your access to and use of the FareWill website at farewill.ca and the purchase and delivery of FareWill products and services. By accessing our website or purchasing a FareWill plan, you agree to be bound by these Terms.
FareWill is operated by Sean Mayers as a sole proprietor in Ontario, Canada. If you do not agree to these Terms, please do not use our services.
FareWill provides a personalised pet end-of-life planning service. Upon purchase, customers receive access to a questionnaire. Upon completion of that questionnaire, FareWill will prepare and deliver a personalised FareWill End-of-Life Plan as a digital document to the customer's email address.
The FareWill End-of-Life Plan consists of two parts:
FareWill plans are personal planning documents only. They are not legal documents and do not constitute a will, trust, legal directive, power of attorney, or any other legally binding instrument.
You must be at least 18 years of age and a resident of Canada (excluding the Province of Quebec) to purchase a FareWill plan. By purchasing, you represent and warrant that you meet these requirements.
Our services are designed specifically for compliance with Ontario and applicable Canadian federal law.
All prices are listed in Canadian dollars (CAD). Payment is processed securely through Stripe. FareWill does not store your payment card information.
Your purchase is complete when payment is confirmed by Stripe. You will receive a confirmation email followed by a separate email containing your questionnaire link.
Following payment, you will receive an email containing a link to your FareWill questionnaire. Your personalised plan will be prepared and delivered to your inbox typically within 48 hours of questionnaire completion.
Delivery times are estimates only and are not guaranteed. Delays may occur during periods of high demand or due to circumstances beyond our control.
Your plan will be delivered to the email address provided at checkout. Please ensure this address is correct before completing your purchase.
We want you to be satisfied with your FareWill plan. Our refund policy is structured as follows:

FareWill plans are personal planning documents intended solely to help pet owners record and communicate their personal preferences and care instructions. They are not legal documents and should not be relied upon as such.
FareWill does not provide legal, financial, veterinary, medical, or professional advice of any kind. For formal legal arrangements such as pet trusts or specific provisions within a Last Will and Testament, you should consult a qualified lawyer. For veterinary care decisions, always consult a licensed veterinarian.
The FareWill website, brand, logo, plan templates, and all associated content are the exclusive intellectual property of Sean Mayers operating as FareWill. You may not reproduce, distribute, or create derivative works from any of our proprietary materials without prior written permission.
The personal content you provide through your questionnaire — including your written messages, pet details, and care instructions — remains your own property. By submitting your responses, you grant FareWill a non-exclusive, worldwide, royalty-free limited licence to use, format, and display your submitted content solely for the purpose of preparing and delivering your plan.
You agree to defend, indemnify, and hold harmless FareWill, Sean Mayers, and any operators or service providers from and against any third-party claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
To the maximum extent permitted by applicable law, FareWill and Sean Mayers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of our services, inability to use our services, or reliance on any FareWill plan document.
Our total cumulative liability to you for any claim arising from or related to your purchase or use of FareWill services shall not exceed the total amount actually paid by you for your FareWill plan.
FareWill services are provided on an "as is" and "as available" basis without warranties or conditions of any kind, whether express or implied. To the fullest extent permissible under applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Your use of FareWill is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to conflict of laws principles.
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your purchase, you agree to first contact us at hello@farewill.ca to attempt in good faith to resolve the dispute informally before initiating formal court proceedings.
Subject to the informal resolution process above and applicable consumer protection legislation, any disputes shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
We reserve the right to update or modify these Terms at any time. When we do, we will update the effective date above. Your continued use of our services after any changes constitutes your acceptance of the updated Terms.
